U.S. Immigration Courts Reject Nearly 80% of Asylum Claims Under New Policies


Recent government statistics show a dramatic shift in how U.S. immigration courts are handling asylum claims. As of early 2026, immigration judges have been denying nearly 80 percent of asylum applications that come before them—up sharply from about 50 percent just a few years ago. This is the highest denial rate on record in recent memory and reflects major changes to asylum adjudication implemented since early 2025.

According to the February 2026 data from Syracuse University’s Transactional Records Access Clearinghouse (TRAC), the denials jumped to 80% in 2025.  This surge, up from roughly 50% in 2023, is driven by accelerated “assembly-line” policies, including tighter “credible fear” standards, high-volume case quotas, and limited access to counsel. U.S. immigration courts are now denying nearly 80 percent of asylum claims under accelerated policies implemented since 2025.

What’s Driving the Surge in Denials?

Experts point to a suite of policy changes designed to fast-track asylum decisions and tighten the criteria for eligibility:

  • Stricter credible-fear standards: Judges are applying narrower definitions of what constitutes a credible fear of persecution, making it harder for applicants to clear the first hurdle in their cases.
  • High case quotas for judges: Each immigration judge is now expected to complete a minimum number of cases per year—reportedly about 700—pressuring faster and less deliberative decisions.
  • New judge appointments: Dozens of new immigration judges with military or law-enforcement backgrounds have been added to the bench, changing the overall adjudication culture.  

Together, these changes have shifted the system toward rapid denial and removal rather than extended review and due-process hearings.

  • Record Denials: The 79.6% denial rate reflects a major, rapid shift in immigration court outcomes.
  • Aggressive Timelines: Courts are clearing backlogs by rapidly denying cases rather than granting them, a trend linked to policies enforced since January 2025.
  • Operational Changes: The system has implemented quotas of 700 cases per judge per year and increased reliance on video hearings.
  • Lower Approval Rates: While over 50% of cases were granted in 2022–2024, the rate dropped to roughly 35.8% by late 2024 and has continued to fall to record lows by early 2026. 

Impact on Deportations and Court Backlogs

The increase in asylum denials is happening alongside a surge in deportations. In December 2025 alone, around 38,000 migrants were removed from the U.S., roughly double the number deported in the same month two years earlier.  

Despite the faster decision pace, the overall court backlog has continued to balloon. With more than 3.3 million cases pending, analysts estimate that even at the current rate, it could take well over a decade to clear the existing docket.  

Broader Concerns and Reactions

Proponents of the changes argue they help weed out unfounded claims and reduce exploitation of the asylum system. Critics, however, warn that due process for asylum seekers is being undermined. Many hearings now occur via video in high-volume dockets with limited access to legal counsel, raising fairness concerns for individuals navigating complex legal claims.  

There’s also anxiety among global businesses that the tougher climate in immigration court could spill over into other types of adjudications, including employment-based transitions for international workers.
