Increase Your Chances of Approval: 5 Tips for O-1 Visa Applicants


☝USCIS issued new guidance how to properly document an O-1B case and updated their adjudication manual (instructions to USCIS officers how to properly make decisions in the submissions for the O-1B visas). Read the new guidance here.

First, generally about O-1 Visas. They are sometimes called Extraordinary Talents Visas. These are nonimmigrant (temporary) employment visas for stars in the fields of arts, education, business, or sports (called O-1A Visa), or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements (called O-1B Visas). This visa requires the applicant to have a sponsor (usually an agent or the company or sports team), but in some cases, to also self-sponsor when they can show they are extraordinary and unique celebrities in their professional endeavors.

🔸Submit a strong and easily digestible application. Use the proper form – USCIS Form I-129 with the O Supplement. Make sure it’s dated and signed everywhere by either the Petitioner company or by you if you are self-petitioning.

🔸The USCIS requires lots of detailed documentation to support your application for the O-1 visa. This includes letters of recommendation, evidence of your achievements in your field, and a detailed itinerary of your work in the US. You should take the time to gather all the necessary documents and present a clear and convincing case for why you qualify for the O-1 visa.

🔸Get a union or other advisory organization that is considered as an organization of professionals in your specific field to provide their advisory opinion letter to qualify you as extraordinary. This is a must!

🔸Show that you have exceptional ability in your field: To be eligible for the O-1 visa, you must demonstrate that you have a level of expertise that is significantly above that of your peers.

✔ This can include documents about your awards and recognitions, publications, interviews and other evidence of your accomplishments in your field.

✔ Your immigration lawyer will likely show that newspapers that published about you have a big circulation, websites and bloggers who talked to you have millions of hits. In other words, the news about your achievements were distributed to the masses on a large scale.

✔ Be sure to highlight your unique skills and contributions, and make a compelling case for why you are the best candidate for the visa.
