In a recent move, the American Immigration Lawyers Association (AILA) launched its new initiative, “A Better Way on Immigration,” which aims to critically assess the destructive changes made by the Trump administration to the U.S. immigration system and offer concrete recommendations for reform. The latest brief highlights the extensive damage caused by these changes, specifically the dismantling of lawful immigration pathways, which has had a lasting and devastating impact on immigrant families, U.S. communities, and the nation’s economy and security.

The Dismantling of Lawful Immigration: A Dangerous Shift

The Trump administration’s rhetoric on immigration often centered around the issue of illegal immigration, framing the debate as a choice between protecting American citizens’ safety and embracing legal immigration. The reality, however, is that their policies have systematically targeted lawful immigration, stripping 1.6 million immigrants of their legal status in less than a year, resulting in the unnecessary suffering of immigrants who came to the U.S. “the right way.”

By focusing on “illegal immigration” and labeling immigrants as “criminals” or “the worst of the worst,” the administration laid the groundwork for mass deportations that have expanded beyond those without legal status to include individuals with long-term ties to the U.S., families, employers, and communities. This strategy not only exacerbates the undocumented population but also weakens the very foundation of the U.S. economy and national security.

Legal Immigration Serves the National Interest

While the administration’s policies claimed to prioritize safety, they have inadvertently harmed the national interest. Legal immigration plays a crucial role in maintaining U.S. competitiveness, economic growth, and national security:

  • Immigrants contribute significantly to the U.S. economy, filling critical labor gaps in industries like agriculture, construction, technology, healthcare, and manufacturing.
  • Over half of all Fortune 500 companies were founded by immigrants or their children, generating billions of dollars in revenue and employing millions of Americans.
  • Immigrants contribute to Social Security, serve in the U.S. military, and bring vital language and cultural expertise to intelligence agencies and diplomatic missions.

Punishing Immigrants Who Play by the Rules

The current administration has shifted its focus from just targeting individuals with unauthorized status to actively punishing those who follow the law.

This includes:

  • Arresting spouses of U.S. citizens during their green card interviews.
  • Cancelling Temporary Protected Status (TPS) for more than 700,000 individuals from countries facing war, disaster, or other extraordinary conditions.
  • Suspending critical immigration programs like Uniting for Ukraine (U4U) and Operation Allies Welcome (OAW), which helped refugees fleeing war and persecution.
  • Freezing processing times for millions of applications, including asylum claims and family reunifications.

By undermining legal pathways and targeting those who comply with immigration laws, the administration has only deepened the immigration crisis while failing to address the broader issues.

Restricting Legal Immigration Increases the Undocumented Population

One of the most counterproductive outcomes of this administration’s policies is the increase in the undocumented population. When lawful immigration is restricted, people seeking refuge or opportunity don’t simply stop coming. Instead, they turn to unauthorized channels to enter the U.S.

This has resulted in:

  • Fear and uncertainty among those eligible for legal status, leading them to avoid necessary immigration procedures.
  • Increasing numbers of immigrants undocumented because their legal pathways have been shut down or made inaccessible.
  • The disruption of families and the continued growth of the undocumented population, which ironically the administration claims to reduce.

A Better Way Forward

Instead of restricting lawful immigration, Congress must restore and protect these pathways to strengthen communities economically and socially. Legal immigration is not a threat to national security or safety; it is vital to the U.S. economy and cultural diversity.

AILA’s recommendations for reform include:

  • Restoring oversight and requiring regular reporting on backlogs and policy shifts.
  • Strengthening immigration policies that support economic needs and protect human rights.
  • Reestablishing USCIS as a service-focused agency, not an enforcement tool.

A new immigration system must balance humane enforcement with pathways that benefit the nation’s economy, security, and values. Congress must commit to modernizing the immigration process in a way that honors our Constitutional protections and serves the interests of all Americans.
